Terms of Service
Please read these terms carefully before using our platform.
Effective date: 1 June 2025
01 — Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of the StreetCredit website, platform, and related services (collectively, the “Services”) operated by StreetCredit (“we”, “us”, or “our”).
By accessing or using our Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Services on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
If you do not agree to these Terms, you must not use our Services.
02 — Description of Services
StreetCredit provides credit infrastructure for African SME lenders, including access to alternative data sources (cashflow, POS transaction data, mobile money history), credit scoring tooling, and related platform services. Our Services are intended for financial institutions, licensed lenders, and accredited business partners.
Access to certain features may be subject to a separate written agreement, pilot programme terms, or cohort acceptance. These Terms apply in all cases unless a separate agreement expressly supersedes them.
03 — Eligibility
The Services are available only to legal entities and individuals who are at least 18 years of age and capable of forming binding contracts under applicable law. By using the Services, you represent and warrant that you meet these requirements.
We reserve the right to refuse service, terminate accounts, or cancel applications at our sole discretion, including where we determine that eligibility requirements have not been met.
04 — User Accounts & Applications
To access certain parts of the Services, you may submit an application or be invited to create an account. You agree to:
- Provide accurate, current, and complete information during registration or application.
- Maintain the security of any credentials associated with your account.
- Notify us immediately of any unauthorised use of your account.
- Accept responsibility for all activity that occurs under your account.
We may verify the information you provide and decline or revoke access if information is found to be inaccurate or misleading.
05 — Acceptable Use
You agree not to use the Services to:
- Violate any applicable law, regulation, or third-party rights.
- Transmit any material that is unlawful, harmful, defamatory, or fraudulent.
- Reverse engineer, decompile, or disassemble any part of the platform.
- Attempt to gain unauthorised access to our systems, networks, or data.
- Scrape, harvest, or extract data from the platform without prior written consent.
- Use the Services in any way that could disable, overburden, or impair our infrastructure.
- Resell, sublicense, or otherwise commercialise the Services without our express written authorisation.
We reserve the right to suspend or terminate access for any violation of these acceptable use provisions, without notice and without liability.
06 — Intellectual Property
All content, features, and functionality of the Services — including but not limited to software, text, graphics, logos, icons, and data models — are the exclusive property of StreetCredit or its licensors and are protected by applicable intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services solely for your internal business purposes in accordance with these Terms. Nothing in these Terms transfers ownership of any intellectual property to you.
Any feedback, suggestions, or ideas you provide to us may be used by us without restriction and without any obligation to compensate you.
07 — Data & Confidentiality
Each party agrees to keep confidential any non-public information received from the other party that is designated as confidential or that reasonably should be understood to be confidential given the nature of the information. This obligation does not apply to information that is publicly available, independently developed, or required to be disclosed by law.
Where applicable, data processing activities under these Terms are governed by our Data Processing Agreement, which forms part of the agreement between StreetCredit and institutional partners.
08 — Disclaimers
The Services are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components. Credit data and scoring outputs provided through the platform are tools to assist decision-making — they do not constitute financial advice and lending decisions remain solely your responsibility.
09 — Limitation of Liability
To the fullest extent permitted by applicable law, StreetCredit and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business opportunities, arising out of or in connection with your use of the Services.
Our total aggregate liability for any claim arising under these Terms shall not exceed the greater of (a) the fees paid by you to StreetCredit in the three months preceding the claim, or (b) USD 100.
10 — Indemnification
You agree to indemnify, defend, and hold harmless StreetCredit and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any applicable law or third-party rights; or (d) any information you submit through the Services.
11 — Modifications to Services & Terms
We reserve the right to modify, suspend, or discontinue the Services (or any part thereof) at any time with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.
We may revise these Terms at any time by updating this page. The revised Terms will take effect immediately upon posting. Your continued use of the Services after any changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically.
12 — Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Lagos State, Nigeria.
Before initiating any legal proceedings, you agree to first attempt to resolve the dispute informally by contacting us at legal@streetcredit.africa. We will attempt in good faith to resolve any dispute within 30 days.
13 — General Provisions
These Terms, together with our Privacy Policy and any applicable partner agreements, constitute the entire agreement between you and StreetCredit regarding the Services and supersede all prior agreements.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision does not constitute a waiver of that right. We may assign our rights and obligations under these Terms without restriction; you may not assign your rights without our prior written consent.
Nothing in these Terms creates any agency, partnership, joint venture, employment, or franchise relationship between you and StreetCredit.
